Ask any hardcore gamer what matters most and nine out of 10 times you'll get a one-word answer?speed. It's no secret that fast frame rates not only give you smoother game play but they can also give you an edge over those unfortunate souls who have to deal with lag and choppy motion. You can spend thousands on a tricked out gaming rig but if your monitor can't display the action smoothly you're not getting the most out of your hardware investment. With the Asus VG248QE , you don't have to worry about ghosting, lag, or choppy action. This 24-inch gaming monitor offers a 1-millisecond (gray-to-gray) pixel response and a 144Hz refresh rate, and it is 3D capable. Its color accuracy is good (not great) and its stand lets you position the panel in any direction for optimal (and comfortable) viewing. Off angle viewing is less than stellar though, and a few more I/O ports would be nice.

Design and Features
The VG248QE uses a design similar to its bigger sibling, the Asus VG278HE. It sports thin glossy black bezels, a glossy black cabinet, and a matching stand that consists of a round base with a Lazy Susan swivel mechanism and a telescoping mounting arm that offers pivot, height, and tilt adjustability. The base has a 3D logo, signifying that the panel is 3D ready, but as with the Asus VG278HE, the monitor does not come with the Nvidia 3D Vision 2 kit needed to view multi-dimensional content, although you can pick one up online for around $130 or so.

There are six clearly labeled function buttons (including the power switch) nestled beneath the lower bezel on the right side. Several of the buttons act as hot keys for things like picture presets and the GamePlus feature, which offers a game timer and an aiming scope to help zero in on your targets. All three video inputs are digital (HDMI, DisplayPort, dual-link DVI) and all are located at the rear of the cabinet facing downward. They are joined by an audio input and a headphone jack. There aren't any USB ports on this model, nor is there an analog video input or a webcam. However, it does include a set of embedded 2-watt speakers that are moderately loud but slightly tinny sounding.

As with every Asus monitor I've reviewed in recent years, the VG248QE offers Splendid Technology, which is really just a fancy name for picture presets. This monitor has six presets, including Scenery, Standard, Theater, Game, sRGB, and Night View modes. Other picture settings include Brightness, Contrast, Color Saturation, Skin Tone, and Color Temperature. There's also a Smart View setting that adds luminance for side angle viewing, but the view from dead center is compromised when this setting is enabled and is best left disabled.

The VG248QE comes with a dual-link DVI cable and an audio cable but you're on your own when it comes to HDMI and DisplayPort cables. The monitor is covered by a three year parts, labor, and backlight warranty.

Performance
For the most part, the VG248QE is a solid performer. Its color accuracy wasn't terrible but it wasn't ideal either. As shown in the chromaticity chart below, the 1920 x 1080 TN panel produced oversaturated greens, but blues and reds were much closer to their CIE (International Commission On Illumination) coordinates. Greens did appear to be a bit heavy in my test photos but not heavy enough to cause tinting.

The VG248QE was able to display almost every shade of gray from the DisplayMate 64-Step Grayscale test, but darks shades of gray could have been a bit darker. There was a hint of clipping at the light end of the scale, which is not uncommon for a TN panel.

As is the case with most TN monitors, the VG248QE has relatively narrow viewing angles. There was some color shifting at around 50-degrees from center from the side and the view from the bottom was dark. This becomes more of an issue when the panel is rotated and the bottom angle becomes the left side angle.

The panel's 1-millisecond pixel response and 144Hz refresh rate combined to deliver an outstanding gaming experience. There was no apparent lag or image smearing while playing Burnout Paradise while connected to a PS3 console. Results were similar while playing the PC-based Far Cry 2 and while watching 2012 on blu-ray disc. Panning scenes were crisp and stutter-free.

The VG248QE used 25 watts of power during testing, which is comparable to the BenQ XL2420TX (28 watts). Neither could touch the efficiency of the Viewsonic VG2437mc-LED, which used only 19 watts of power.

The Asus VG248QE is a capable 24-inch gaming monitor that uses 144Hz refresh technology and a speedy 1-ms pixel response to deliver smooth game play. Its viewing angle performance comes up short and it lacks the gear needed for 3D gaming, but if smooth motion handling is a must, this monitor delivers. That said, our current Editors' Choice for mid-sized gaming monitors, the BenQ XL2420TX, also offers very good motion performance and comes with a multitude of I/O ports and a 3D Vision 2 kit, but it'll cost you a couple of hundred dollars more.

Appeals board upholds permit for Christo project

DENVER (AP) ? An appeals board is upholding the Bureau of Land Management's decision to grant the artist Christo a permit for his Over the River project, which involves temporarily suspending 5.9 miles worth of silvery fabric panels in sections over 42 miles of the Arkansas River.

The Interior Board of Land Appeals on Friday rejected arguments that the BLM didn't fully consider impacts of Over the River before granting the permit.

Meanwhile, two lawsuits challenging Over the River in state and federal courts are still pending.

"We can now move on from the agency hijinks and into federal court where we can get an unbiased review of this project," said Michael Harris, a lawyer representing the group Rags Over the Arkansas River, which is trying to block Christo's plan. "We fully expect the court to find that the OTR project approval is illegal."

New York-based Christo said in a written statement that he remains confident that state and federal permitting processes were thorough and complete. "This is one of three legal hurdles that needed to be overcome, and I am very happy with this decision," Christo said.

Even if Christo wins in the lawsuits, it would be at least 2016 before the project would be ready for public display.

He and his late wife, Jeanne-Claude, got their first inkling for Over the River in 1992.

Work to set up a system of anchors and cables to suspend the fabric panels over the river would unfold over roughly two years. The project would be displayed for two weeks in the month of August, when the river would be calm enough for rafters to peer up at the fabric as they float underneath and when drivers on U.S. 50 along the river could look down.

Denver-based environmental consultant Rocky Smith, who was among those filing the administrative appeal of the BLM's permitting decision, said he still thinks Over the River is "horribly inappropriate" for the canyon Christo plans to use.

Opponents contend the project threatens bighorn sheep, public safety, traffic on U.S. 50, and businesses that depend on the scenic river to draw anglers, rafters and tourists.

Christo's team has said it plans dozens of measures to mitigate impacts.

NEW YORK (AP) ? U.S. stock futures are rising for a fourth consecutive day, capping the biggest rally for S&P 500 index since January, thanks to a healthy dose of favorable economic news.

The S&P is now up 13 percent for the year, which makes it the best first half for the index since 2008.

Dow Jones industrial futures are up 23 points to 14,959. S&P futures have added 2.6 points to 1,609.20. Nasdaq futures are up 3.5 points to 2,903.

U.S. futures followed Asian markets higher Friday after a closely watched consumer price index in Japan, which has battled deflation for years, stopped falling for the first time in seven months.

Also on Friday, the Institute for Supply Management posts its gauge of business activity for June from Chicago.

Colorado theater gunman to be tethered to courtroom floor for trial

DENVER (Reuters) - A Colorado judge ruled on Thursday that accused theater gunman James Holmes will tethered to the courtroom floor by a cable for security reasons during his murder trial, but denied a defense request to sequester the jury.

Holmes is charged with multiple counts of first-degree murder and attempted murder stemming from a shooting rampage last July that killed 12 moviegoers during a midnight screening of the Batman film "The Dark Knight Rises" at a suburban Denver cinema.

Fifty-eight other people in the audience were wounded by gunfire and a dozen others suffered other injuries in the ensuing pandemonium.

Prosecutors have said they intend to seek the death penalty against Holmes, 25, if he is convicted.

The California native and former University of Colorado graduate student of neuroscience has pleaded not guilty by reason of insanity.

Holmes' public defenders have argued that allowing jurors to see their client handcuffed and shackled, as he has been in all of his court appearances so far, would unfairly prejudice them against the accused gunman.

Arapahoe County District Judge Carlos Samour Jr. agreed, but said Holmes poses a security risk and that public safety requires that he be restrained during the proceedings.

Holmes will wear a harness under his street clothes with a cable bolting him to the courtroom floor, the judge said.

The cable will be visible to jurors, Samour said, but should be indistinguishable from computer cords emanating from the defense table.

In a separate ruling, the judge denied a defense motion requesting that jurors be sequestered during the trial, which is scheduled to start in February 2014 and is expected to last for about four months.

Jury sequestration is "an extremely rare procedure," the judge said, noting that it would be expensive and impractical to keep jurors sealed off from the outside world for the duration of the trial.

Defense lawyers can renew the request later if issues arise that warrant another look, Samour said.

Friend: Trayvon Martin encounter racially charged

SANFORD, Fla. (AP) ? A friend of Trayvon Martin's who was on the phone with him shortly before his fatal fight with George Zimmerman testified Thursday that she thought the encounter was racially charged.

Rachel Jeantel testified for the second day in a row, saying she thought race was an issue because Martin told her he was being followed by a white man.

"He was being followed," Jeantel said.

Her answer came in response to questioning from defense attorney Don West about why she had given differing accounts about what she had heard over the phone when Martin first encountered Zimmerman on a rainy night on Feb. 26, 2012, at the Retreat at Twin Lakes townhome complex.

West suggested in his cross-examination that 19-year-old Jeantel had raised the racial issue in some accounts but not others. In some accounts, West implied, Jeantel said Zimmerman responded one way when he first encountered Martin, but in other accounts she said he responded another way. Jeantel gave her version of events in a deposition, in a letter to Martin's mother and in a recorded interview with an attorney for the Martin family.

Jeantel is one of the prosecution's most important witnesses because she bolsters the contention that Zimmerman was the aggressor. She was on the phone with Martin moments before he was fatally shot.

Jeantel testified Wednesday that her friend's last words were "Get off! Get off!" before the phone went silent. But on Thursday, under cross-examination, she conceded that she hadn't mentioned that in her account of what happened to Martin's mother, Sybrina Fulton.

She had left out some details to spare Fulton's feelings, and also because neither Fulton nor the Martin family attorney asked her directly about them, Jeantel said. At one point, West handed her a letter she had written with the help of a friend to Martin's mother explaining what happened. She looked at it but then said she couldn't read cursive handwriting.

When asked by West if she had previously told investigators that she heard what sounded like somebody being hit at the end of her call with Martin, Jeantel said, "Trayvon got hit."

"You don't know that? Do you? You don't know that Trayvon got hit," West answered angrily. "You don't know that Trayvon didn't at that moment take his fists and drive them into George Zimmerman's face."

Later in the morning, West accused Jeantel of not calling police after she lost contact with Martin because she thought it was a fight he had provoked.

"That's why you weren't worried. That's why you didn't do anything because Trayvon Martin started the fight and you knew that," West said.

"No sir!" Jeantel said. "I don't know what you're talking about."

Jeantel recounted to jurors on Wednesday how Martin told her he was being followed by a man as he walked through the Retreat at Twin Lakes townhome complex on his way back from a convenience store to the home of his father's fiancee.

She testified that Martin described the man following him as "a creepy-ass cracker" and that he thought he had evaded him. But she said Martin told her a short time later the man was still behind him, and she told him to run.

Martin said Zimmerman was behind him and she heard Martin ask: "What are you following me for?"

In one account, according to West, she said Zimmerman responds, "What are you doing around here?" In another account, according to West, she says Zimmerman said, "What are you talking about?"

She then heard what sounded like Martin's phone earpiece dropping into wet grass, and she heard him say, "Get off! Get off!" The phone then went dead, she said.

Later, she bristled and teared up when West asked her why she didn't attend Martin's funeral and about lying about her age. She initially told Martin's parents she was a minor when she was 18. She said she didn't want to get involved in the case.

The exchanges also turned testy, including one moment when she urged West to move on to his next question: "You can go. You can go." And she gave him what seemed like a dirty look as he walked away after he had approached her on the stand to challenge her on differences between an initial interview she gave to Martin family attorney, Benjamin Crump, and a later deposition with the defense. Jeantel explained it by saying she "rushed" the interview with Crump because she didn't feel comfortable doing it.

And when the judge asked if both sides wanted to break for the day, prosecutors said they'd like to continue, believing the testimony could take another two hours, to which Jeantel reacted with surprise, repeating, "Two hours?" Instead, the judge decided to continue the cross examination Thursday, carefully instructing Jeantel to return at 9 a.m. and not discuss her testimony with anyone.

Jeantel's testimony was more subdued on Thursday, and West took note of her calmer demeanor. She answered many of West's questions by repeating "yes, sir," almost in a whisper.

"You feeling OK today? You seem different than yesterday," West said.

"I got some sleep," she answered.

Zimmerman, 29, could get life in prison if convicted of second-degree murder. Zimmerman followed Martin in his truck and called a police dispatch number before he and the teen got into a fight.

Zimmerman has said he opened fire only after the teenager jumped him and began slamming his head against the concrete sidewalk. Zimmerman identifies himself as Hispanic and has denied the confrontation had anything to do with race, as Martin's family and their supporters have claimed.

Having a job helps women with HIV manage their illnesses, according to researchers from Case Western Reserve University and the University of California at San Francisco.

The routine of a work schedule, plus the job-related money and benefits, provides extra emotional support for these women, said Allison Webel, assistant professor of nursing at Case Western Reserve University's Frances Payne Bolton School of Nursing and the study's lead author.

Findings in the National Institutes of Health-supported study were published this month in Social Science & Medicine.

The positive effect of work for women with HIV was based on surveying 260 participants about their social resources. The respondents had an average age of 46, many were mothers, and African American. The researchers, who do not know why, also found African Americans were better able to self-manage the daily disease-related tasks than women from other ethnic groups.

Self-management is a series of daily tasks, from taking medications, exercising and eating right to marshaling support when needed and keeping doctor appointments.

According the Centers for Disease Control and Prevention, about 25 percent of the HIV population nationally (50 percent worldwide) are women.

Many have limited financial means and live in poverty or are homeless, making it difficult to maintain their medications and keep health appointments that keep them healthy, Webel said.

But Webel explained that women who juggle many different responsibilities may find it hard to maintain a health routine but for those who do maintain one increase their chances of living a normal life span.

In the past, many women left jobs to battle HIV and take care of their health. Current HIV antiretroviral therapies play an important role in preventing the illness from developing into AIDS and may help delay HIV-related illnesses, such as cancer, heart disease and liver infections.

"Women want to work and now find they can and live well with HIV," Webel said.

The researchers found that work offers these women the positive psychological effect of contributing to the world outside their homes. Obviously, having a job also increases family income and can provide muchneeded benefits.

The researchers found that low incomes and lack of advanced education and training prevent many women from finding gainful employment. The researchers called for more training programs to help these women find and hold jobs.

The researchers also suggested further investigation into establishing microenterprises nationallysmall businesses similar to those established in developing countries that provide income for women with HIV to cover such necessities as food and housing.

Summer's here! And while many favorite and critically acclaimed shows have ended their seasons (see you next year, Don Draper!), summer blockbusters are starting to show up in theaters and many popular television programs are returning to the airwaves.

"Casablanca," "The Sopranos," "The Simpsons" and "The Godfather Part 2" all made Entertainment Weekly's list of top movies and TV shows ever.

And as the summer entertainment season kicks into gear, Entertainment Weekly has unveiled its list of All Time Greatest TV Shows and Movies.

On Wednesday morning, the top five results for each category were revealed on TODAY.

Gangsters, outlaws, star-crossed lovers and creepy shower killers are among those viewers meet in the magazine's films list -- and not one of the movies that made the top five came along after America?s bicentennial.

The No. 1 pick is "Citizen Kane," the 1942 saga of old-school journalism.

The gritty and engrossing tales of mob life in "The Godfather" (1972) and "The Godfather Part 2" (1974) tie for second place in the roundup. In third is 1967's murder and mayhem-filled "Bonnie and Clyde." The classic tale of war-torn love, "Casablanca" (1942), takes the fourth spot. And 1960?s legendary ?Psycho,? dubbed the ?granddaddy of all slasher films,? rounds out the list.

(Before the EW results were revealed, we put the contenders to a vote and our readers put "The Godfather" films way ahead of the others, with "Casablanca" a distant second and "Citizen Kane," "Psycho," and "Bonnie and Clyde" trailing at the end of the list.)

On the small screen, only one of the magazine's top five picks for All Time Greatest TV Shows is still on the air. (Seriously, "Breaking Bad," "Walking Dead" and "Game of Thrones" didn't crack the summit of the list!)

Topping the list is complex crime drama "The Wire," which wrapped up its run in 2008.

The still-on-the-air show in second place is Fox's very long-running "The Simpsons." "Seinfeld," which aired its last episode in 1998, comes in at third place, followed by "The Mary Tyler Moore Show" (1977) in fourth. "The Sopranos," the HBO antihero drama that ended in 2007, takes fifth.

Ouya looks to make a dent in game console market

NEW YORK (AP) ? Ouya, maker of a bite-sized game console that runs Google's Android operating system, wants to take a bite out the video game triumvirate of Microsoft, Sony and Nintendo.

The console, which went on sale Tuesday for $100, lets players try games for free before buying them, a selling point Ouya (pronounced oo-yah) CEO Julie Uhrman often makes to underscore that gamers who use consoles made by "the big three" can't test games before they spend as much as $60 to purchase them.

"We are definitely disrupting the console market," Uhrman says. "I mean, there's been no startup that has had a meaningful impact on the market in decades, and we're the first. We offer something different."

So far, Ouya's pitch seems to be working. The underdog console had sold out on Amazon.com and on Target's website by Tuesday afternoon. It is available at other outlets, including Best Buy and GameStop.

The Ouya game cube measures about 3 inches on each side and hooks up to a TV set. The console comes with a single controller. Additional controllers cost $50.

There are nearly 180 games available for Ouya, ranging from the likes of "Crazy Cat Lady" to the more established "Final Fantasy III" from Square Enix. The company says more games are on the way. There are also some non-gaming apps, such as online music service TuneIn Radio.

The games are sold through Ouya's storefront, not Google Play, the app store where people buy games for Android tablets and mobile devices. Pricing is left up to individual game developers; many games are in the single digits. "Final Fantasy" is an exception at $16. Ouya takes a 30 percent cut from the game developers.

While you won't find "Grand Theft Auto IV" or the latest "Call of Duty" among the available titles, there are plenty of others from independent developers whose games may never make it onto the dominant consoles, Microsoft's Xbox, Sony's PlayStation and Nintendo's Wii.

"I don't think it's ever really going to challenge the big three, but it offers a lot to the more casual gamer," says Anthony Yacullo, a self-described "gadget geek" from Lawrenceville, N.J. Like thousands of other gamers and game developers, Yacullo already has an Ouya. He contributed at least $95 to the company through crowdfunding website, Kickstarter.

"When I'm out on the road for work and come home, I don't want to play 'Call of Duty," he says. Rather, Yacullo says he looks for games more like the ones on his phone ? except he doesn't want to be staring at his phone.

That's where Ouya comes in. Still, the new console is unlikely to present a serious challenge to high-end consoles coming out from Sony Corp. and Microsoft Corp. later this year. Ouya lacks recent blockbuster games with high-end graphics. But at a fraction of the price (the Xbox One will cost $500 and the PlayStation 4, $400), it appeals to budget-conscious gamers, gadget geeks and those looking for an alternative to gaming power-trio.

Gartner analyst Brian Blau says the measure of Ouya's success will not be the number of consoles it sells but the amount of money game developers make ?and whether there is a steady stream of new games for the device. What's missing now, he adds, is the big-name video game brands such as Activision and Electronic Arts supporting Ouya.

That could come later.

The project to build the Ouya console launched on Kickstarter last July. On Aug. 9, 2012, Ouya's funding period ended with $8.6 million pledged, more than nine times the original $950,000 goal its creators had set. More than 63,000 people donated, with 12 pledging $10,000 or more.

"We brought it to Kickstarter because we wanted to know if anybody really wanted this," Uhrman says. "We had talked with developers and industry veterans like (video game designer) Brian Fargo and Ed Fries, who is one of the founders, basically, of Xbox, and there was a general feeling that there was a void in the market place for soemthing. But we wanted to validate it."

This May, Santa Monica, Calif.-based Ouya received another $15 million in venture capital funding from Kleiner Perkins Caufield & Byers, other VC firms, and chip maker Nvidia.

Ouya is not the first independent game console to attempt a challenge to the big three console makers. Four years ago, a startup called OnLive launched, offering games streamed over an Internet connection, similar to the way Netflix offers streamed movies and TV shows. OnLive's small game consoles went on sale for $99 in 2010, but they never gained broad appeal or even made a dent in the traditional console market.

Another early backer, Pedro Amador-Gates, thinks Ouya should "not even go after the consoles," but rather appeal to hobbyists and do-it-yourself folks.

"This is like a baby system compared to an about-to-be upgraded gaming system," he says, referring to the Xbox one and the PS4. But, much like it was with the early cell phone games, "it will only get better."

NEW YORK (AP) ? Nerlens Noel is coming off a major knee injury. Alex Len is in a walking boot.

One of them could be the No. 1 pick Thursday in an NBA draft that appears short on stardom, and neither looks ready to get his career off to a running start.

"This draft is really unpredictable, a lot of guys with injuries and you don't have any, like, LeBron James," Len said Wednesday. "So it's going to be interesting."

Ten years after James climbed on stage to start a draft that goes down as one of the best in recent memory, the No. 1 pick again belongs to Cleveland.

The Cavaliers won't find anyone who can play like James on the court ? if they keep the pick ? and even the climbing the stage part will be a challenge for the big men who opened their college seasons against each other and are competing again now.

Noel tore the ACL in his left knee on Feb. 12, ending his lone season at Kentucky. The 6-foot-11 freshman led the nation in shot blocking and his conference in rebounding, but hasn't been able to show the Cavaliers if his offensive game has grown.

The only basketball work he did during his visit to Cleveland was shooting some free throws. Perhaps the pants he wore with his sports jacket and orange tie were just too tight, but Noel was walking gingerly as he exited a hotel ballroom after meeting with the media Wednesday.

"I wanted to do more. Unfortunately I got hurt, but I mean I definitely felt right before I got injured I was really coming along as a player and just really coming into my own during that part of the season," Noel said. "But like I said, unfortunately I got hurt, so I wasn't able to show as much as I wanted to."

Nor has Len, but that hasn't stopped the 7-1 center from the Ukraine who spent two seasons at Maryland from climbing into the mix at No. 1. His left foot started bothering him around February, and he found out after the season that it was a stress fracture.

He was aware he was projected as a top-10 pick before the draft combine, but may go much higher even though his visits to teams have consisted of nothing more than interviews. He no longer needs crutches but will be in the boot for perhaps two more weeks.

So, with all these injury questions, what about playing it safe and picking a healthy guy?

"I mean, probably a lot of people wish it could be that easy," Kansas guard Ben McLemore said. "But it's a process for the teams, they've got to see what's available and what they really need. And like I said, this draft is up in the air and nobody knows what's going to happen, who's going to get drafted in which order."

Orlando has the No. 2 pick, followed by Washington, Charlotte and Phoenix.

McLemore, Indiana's Victor Oladipo, Georgetown forward Otto Porter and national player of the year Trey Burke of Michigan are among the other players who will hear their names called early at Barclays Center by NBA Commissioner David Stern in his final draft.

It's a class that won't draw any comparisons to the one that James led, which featured future Miami Heat teammates Dwyane Wade and Chris Bosh, along with NBA scoring champion Carmelo Anthony among the first five picks.

Brooklyn Nets general manager Billy King said a number of teams are trying to trade out of the draft and acquire extra picks for next year, which is expected to be a stronger class. But he doesn't know if there will be enough teams interested in being trade partners to get those deals done.

"There are good players in this draft, but right now, there are not impact players. What I mean by that is that there's no one you look at in this draft that within two years will be an All-Star, say like Kyrie Irving was, players like that," said Minnesota Timberwolves president Flip Saunders, referring to the guard Cleveland took with the No. 1 pick in 2011.

"And so in order for you to move up and dilute your talent pool and your roster, you've got to get an impact-type player, and I just don't believe ... there's good players, probably pretty good players in this league, but are they going to be that impact player who's going to be an All-Star or future Hall of Famer? That's what you don't see. And sometimes that's something you don't see for two or three years in a row."

McLemore has in some ways been hurt by healthy, since by being able to work out he's given teams something to nitpick. Noel and Len have been largely free of criticism while sitting on the sideline.

Instead, Len is hoping his first impression of the season is one that holds up, when he had a career-high 23 points, 12 rebounds and four blocks against Noel in Maryland's loss to Kentucky, right in the building where they will be Thursday.

"I did well against him. So, it's not up to me, it's up to teams," Len said of a team choosing between the two.

Neither player said he knows what the Cavs will do. There has been speculation they are open to dealing the pick, something teams rarely consider in a year with a clear-cut No. 1.

Noel said he had gotten no sense from the Cavs that they had concern about his knee, which could keep him off the court until early in the regular season. And in a draft full of questions, he believes selecting him is the right answer.

"I'm a good teammate, I definitely love to work," Noel said. "I want to get better. I want to be great, I want to reach my potential, be the best player I can be. I definitely do countless hours in the gym and I'm definitely working to get there."

High court to hear Obama recess appointments case

WASHINGTON (AP) ? The Supreme Court on Monday waded into a major constitutional clash between President Barack Obama and congressional Republicans that could fundamentally limit a president's use of recess appointments to fill high-level administration posts.

The justices will review a federal appeals court ruling that found Obama overstepped his authority when he bypassed the Senate last year to fill three vacancies on the National Labor Relations Board.

The case ? to be decided next term ? highlights the growing partisanship that has led GOP lawmakers to stall or filibuster several of Obama's choices to head federal agencies that Republicans distrust. That includes nominees to the labor board, which has issued several union-friendly decisions, and the newly formed Consumer Financial Protection Bureau.

The Constitution gives the president the power to make temporary appointments to fill positions that otherwise require confirmation by the Senate, but only when the Senate is in recess.

At issue for the Supreme Court: What constitutes a congressional recess and does it matter when a vacancy occurs?

A three-judge panel of the U.S. Court of Appeals in Washington, D.C., held earlier this year that recess appointments can be made only during the once-a-year break between sessions of Congress. Two judges on the panel also ruled ? for the first time ? that a vacancy must occur while the Senate is away in order to be filled during the same break.

If the Supreme Court agrees, it would make it nearly impossible for a president to use the recess power, giving the opposition party in Congress the ability to block administration nominees indefinitely.

"Should they uphold the D.C. Circuit, it would be a major blow to presidential power," said Sanford Levinson, a constitutional law professor at the University of Texas. "The rationale for recess appointments in the modern world is much more the ability of the president to staff his administration in the face of Senate hostility."

Obama has made relatively few recess appointments, 32 in his four-plus years in office, according to the Congressional Research Service. Bush made 171 such appointments and President Bill Clinton filled 139 posts that way in their eight years in office, the research service said.

The Obama administration argues the ruling is a radical departure from precedent that would invalidate hundreds of recess appointments made by presidents of both parties over more than 100 years. Those appointments include "three Cabinet secretaries, five court of appeals judges, 10 district court judges, a director of Central Intelligence, a chairman of the Federal Reserve, numerous members of multi-member boards, and holders of a variety of other critical government posts," Solicitor General Donald Verrilli said in his petition to the Supreme Court.

But all 45 Republicans in the Senate ? led by Minority Leader Mitch McConnell, of Kentucky? have filed a friend of the court brief asserting that Obama "made an unprecedented power grab" by making the recess picks.

The nature of the president's actions, during brief Senate breaks that Congress explicitly said were not formal recesses, is driving the current legal controversy.

The case stems from Obama's decision to fill the three NLRB vacancies on Jan. 4, 2012, with Congress on an extended holiday break. At the same time, however, the Senate held brief, pro forma sessions every few days as part of the Republicans' explicit strategy of keeping Obama from filling vacancies through recess appointments. The president also used a recess appointment to install Richard Cordray as head of the financial protection agency, a nomination the GOP had blocked for a year and a half.

In taking up the case, the court said it would also consider the narrower question of whether recess appointments can be made during pro forma sessions ? where one senator gavels in and out for a few minutes every three days. The appeals court did not address the issue of how short a break can count as a recess.

The case challenging the appointments was brought by Noel Canning, a Washington state bottling company, which claimed an NLRB decision against it was not valid because the board members were not properly appointed and that the board did not have enough members to do business without the improperly appointed officials.

Since the Canning decision, a second federal appeals court in Philadelphia issued a similar opinion finding that recess appointments can be made only between sessions of the Senate. But on three earlier occasions, federal appeals courts have upheld recess appointments.

If the latest rulings stand, they could invalidate more than 1,600 NLRB decisions, and call into question the legitimacy of enforcement actions by the Consumer Financial Protection Bureau, many of which affect the mortgage industry.

The NLRB would effectively be shut down as a ruling against the administration would leave the board with only one member, and it needs three to conduct business.

The Consumer Financial Protection Bureau likewise would have to cease all investigations against mortgage lenders and other financial entities.

"It's going to be sheer chaos," said Alan Kaplinsky, a consumer financial services attorney based in Philadelphia. "If the court determines it was not valid, then literally almost every act taken by the CFPB since January 2012 will be under a huge cloud of uncertainty."

Obama used the recess appointment to install Deputy Labor Secretary Sharon Block, union lawyer Richard Griffin and NLRB counsel Terence Flynn to fill vacancies on the labor board, giving it a full contingent for the first time in more than a year. Block and Griffin are Democrats, while Flynn is a Republican. Flynn stepped down from the board last year.

The parties' roles were reversed when a Republican President George W. Bush was in the White House and Democrats controlled the Senate in the final two years of Bush's presidency. Then, Senate Majority Leader Harry Reid employed the same tactic of convening the Senate every few days to keep Bush from filling vacancies through recess appointments. Unlike Obama, Bush did not press the issue.

Two mutations triggered an evolutionary leap 500 million years ago

June 24, 2013 ? Evolution, it seems, sometimes jumps instead of crawls. A research team led by a University of Chicago scientist has discovered two key mutations that sparked a hormonal revolution 500 million years ago.

In a feat of "molecular time travel," the researchers resurrected and analyzed the functions of the ancestors of genes that play key roles in modern human reproduction, development, immunity and cancer. By re-creating the same DNA changes that occurred during those genes' ancient history, the team showed that two mutations set the stage for hormones like estrogen, testosterone and cortisol to take on their crucial present-day roles.

"Changes in just two letters of the genetic code in our deep evolutionary past caused a massive shift in the function of one protein and set in motion the evolution of our present-day hormonal and reproductive systems," said Joe Thornton, PhD, professor of human genetics and ecology & evolution at the University of Chicago, who led the study.

"If those two mutations had not happened, our bodies today would have to use different mechanisms to regulate pregnancy, libido, the response to stress, kidney function, inflammation, and the development of male and female characteristics at puberty," Thornton said.

The findings were published online June 24 in the Proceedings of the National Academy of Sciences.

Understanding how the genetic code of a protein determines its functions would allow biochemists to better design drugs and predict the effects of mutations on disease. Thornton said the discovery shows how evolutionary analysis of proteins' histories can advance this goal, Before the group's work, it was not previously known how the various steroid receptors in modern species distinguish estrogens from other hormones.

The team, which included researchers from the University of Oregon, Emory University and the Scripps Research Institute, studied the evolution of a family of proteins called steroid hormone receptors, which mediate the effects of hormones on reproduction, development and physiology. Without receptor proteins, these hormones cannot affect the body's cells.

Thornton's group traced how the ancestor of the entire receptor family -- which recognized only estrogens -- evolved into descendant proteins capable of recognizing other steroid hormones, such as testosterone, progesterone and the stress hormone cortisol.

To do so, the group used a gene "resurrection" strategy. They first inferred the genetic sequences of ancient receptor proteins, using computational methods to work their way back up the tree of life from a database of hundreds of present-day receptor sequences. They then biochemically synthesized these ancient DNA sequences and used molecular assays to determine the receptors' sensitivity to various hormones.

Thornton's team narrowed down the time range during which the capacity to recognize non-estrogen steroids evolved, to a period about 500 million years ago, before the dawn of vertebrate animals on Earth. They then identified the most important mutations that occurred during that interval by introducing them into the reconstructed ancestral proteins. By measuring how the mutations affected the receptor's structure and function, the team could re-create ancient molecular evolution in the laboratory.

They found that just two changes in the ancient receptor's gene sequence caused a 70,000-fold shift in preference away from estrogens toward other steroid hormones. The researchers also used biophysical techniques to identify the precise atomic-level mechanisms by which the mutations affected the protein's functions. Although only a few atoms in the protein were changed, this radically rewired the network of interactions between the receptor and the hormone, leading to a massive change in function.

"Our findings show that new molecular functions can evolve by sudden large leaps due to a few tiny changes in the genetic code," Thornton said. He pointed out that, along with the two key changes in the receptor, additional mutations, the precise effects of which are not yet known, were necessary for the full effects of hormone signaling on the body to evolve.

Brain cancer: Hunger for amino acids makes it more aggressive

June 24, 2013 ? An enzyme that facilitates the breakdown of specific amino acids makes brain cancers particularly aggressive. Scientists have discovered this in an attempt to find new targets for therapies against this dangerous disease.

To fuel phases of fast and aggressive growth, tumors need higher-than-normal amounts of energy and the molecular building blocks needed to build new cellular components. Cancer cells therefore consume a lot of sugar (glucose A number of tumors are also able to catabolize the amino acid glutamine, an important building block of proteins. A key enzyme in amino acid decomposition is isocitrate dehydrogenase (IDH). Several years ago, scientists discovered mutations in the gene coding for IDH in numerous types of brain cancer. Very malignant brain tumors called primary glioblastomas carry an intact IDH gene, whereas those that grow more slowly usually have a defective form.

"The study of the IDH gene currently is one of the most important diagnostic criteria for differentiating glioblastomas from other brain cancers that grow more slowly," says Dr. Bernhard Radlwimmer from the German Cancer Research Center (Deutsches Krebsforschungszentrum, DKFZ). "We wanted to find out what spurs the aggressive growth of glioblastomas." In collaboration with scientists from other institutes including Heidelberg University Hospital, Dr. Martje T?njes and Dr. Sebastian Barbus from Radlwimmer's team compared gene activity profiles from several hundred brain tumors. They aimed to find out whether either altered or intact IDH show further, specific genetic characteristics that might help explain the aggressiveness of the disease.

The researchers found a significant difference between the two groups in the highly increased activity of the gene for the BCAT1 enzyme, which in normal brain tissue is responsible for breaking down so-called branched-chain amino acids. However, Radlwimmer's team discovered, only those tumor cells whose IDH gene is not mutated produce BCAT1. "This is not surprising, because as IDH breaks down amino acids, it produces ketoglutarate -- a molecule which BCAT1 needs. This explains why BCAT1 is produced only in tumor cells carrying intact IDH. The two enzymes seem to form a kind of functional unit in amino acid catabolism," says Bernhard Radlwimmer.

Glioblastomas are particularly dreaded because they aggressively invade the healthy brain tissue that surrounds them. When the researchers used a pharmacological substance to block BCAT1's effects, the tumor cells lost their invasive capacity. In addition, the cells released less of the glutamate neurotransmitter. High glutamate release is responsible for severe neurological symptoms such as epileptic seizures, which are frequently associated with the disease. When transferred to mice, glioblastoma cells in which the BCAT1 gene had been blocked no longer grew into tumors.

"Altogether, we can see that overexpression of BCAT1 contributes to the aggressiveness of glioblastoma cells," Radlwimmer says. The study suggests that the two enzymes, BCAT1 and IDH, cooperate in the decomposition of branched-chain amino acids. These protein building blocks appear to act as a "food source" that increases the cancer cells' aggressiveness. Branched-chain amino acids also play a significant role in metabolic diseases such as diabetes. This is the first time that scientists have been able to show the role of these amino acids in the growth of malignant tumors.

"The good news," sums up Radlwimmer, "is that we have found another target for therapies in BCAT1. In collaboration with Bayer Healthcare, we have already started searching for agents that might be specifically directed against this enzyme." The researchers also plan to investigate whether BCAT1 expression may serve as an additional marker to diagnose the malignancy of brain cancer.

Titan Unmasked: 1st Map of Saturn Moon's Topography Revealed

Scientists have pieced together the first-ever global topographic map of Titan, Saturn's largest moon, using radar observations from veteran NASA spacecraft.

The new map of Titan was stitched together from radar observations of the moon by NASA's Cassini spacecraft. It reveals an unprecedented look at Titan's surface and should help scientists learn more about one of the most Earth-like bodies in the solar system, members of the mapping team said.

"Titan has so much interesting activity ? like flowing liquids and moving sand dunes ? but to understand these processes it's useful to know how the terrain slopes," Ralph Lorenz, a member of the Cassini spacecraft's radar team at the Johns Hopkins University Applied Physics Laboratory in Laurel, Md., who led the map design effort, said in a statement. "It's especially helpful to those studying hydrology and modeling Titan's climate and weather, who need to know whether there is high ground or low ground driving their models." Titan is the second largest moon in the solar system, and the only one known to have clouds and a dense atmosphere. Scientists have been keen to study the cloud-covered world because of its Earth-like qualities. Titan's atmosphere, like Earth, is primarily composed of nitrogen, but instead of water, Titan's rain, clouds and?lakes are made of methane.

Titan's nitrogen-rich atmosphere also contains organic chemicals that are derived from methane, which may hold clues to the building blocks of life as we know it, the researchers said.

Seeing through the clouds

Typically, NASA maps the topography of planetary bodies using remote cameras to observe the shapes and shadows of the landscape.?Titan's thick atmosphere, however, makes this difficult, the researchers explained.

NASA's?Cassini probe has flown by Titan nearly 100 times since it arrived at Saturn in 2004. As the spacecraft swings past the hazy moon, it uses a radar imager to pierce through the clouds. These radar measurements can then be used to estimate the heights of topographical features on the moon.

But, since Cassini is only able to observe Titan on flybys, putting together a complete map of its surface is challenging.

"We have only imaged about half of Titan's surface, and multiple 'looks' or special observations are needed to estimate the surface heights," Lorenz said. "If you divided Titan into 1-degree by 1-degree [latitude and longitude] squares, only 11 percent of those squares have topography data in them."

To create a global map, Lorenz and his colleagues used a mathematical process called "splining," which uses smooth, curved surfaces to stitch together grids of existing data.

"You can take a spot where there is no data, look how close it is to the nearest data, and use various approaches of averaging and estimating to calculate your best guess," Lorenz said. "If you pick a point, and all the nearby points are high altitude, you'd need a special reason for thinking that point would be lower. We're mathematically papering over the gaps in our coverage."

Piecing together the puzzle

Scientists already knew that Titan's polar regions are lower in altitude than regions around the equator, but the new topographic map fills in details that will enable researchers to make more accurate models of how and where Titan's rivers flow, and seasonal distribution of the moon's?methane rainfall.

"The movement of sands and the flow of liquids are influenced by slopes, and mountains can trigger cloud formation and therefore rainfall," Lorenz said. "This global product now gives modelers a convenient description of this key factor in Titan's dynamic climate system."

The map was compiled using data from 2012, but Lorenz said it may be updated when the Cassini spacecraft's mission ends in 2017. In the meantime, the scientists are hoping the newly compiled topographical information will spur new research on Titan.

"With this new topographic map, one of the most fascinating and dynamic worlds in our solar system now pops out in 3D," Steve Wall, deputy team leader of Cassini's radar team at NASA's Jet Propulsion Laboratory in Pasadena, Calif., said in a statement. "On Earth, rivers, volcanoes and even weather are closely related to heights of surfaces ? we're now eager to see what we can learn from them on Titan."

The map was published in the July 2013 issue of the journal Icarus.

How to save battery life on your iPhone and iPad by tweaking Notification Center settings

iPhone and iPad battery life is a precious commodity we just can't seem to get enough of. All of our social networks, email accounts, texts, and other apps want to send us notifications, which in turn, consumes more battery life. Sometimes tweaking settings in Notification Center can actually save quite a bit of battery life.

Here's what we recommend trying:

1. Launch the Settings app from the Home screen of your iPhone or iPad.
2. Tap on Notifications.
3. FInd an app that frequently sends you notifications and tap on its name.
4. Scroll down towards the bottom and you'll see an option for View in Lock Screen.
5. Turn this option to Off for any apps that aren't important to be displayed on your Lock Screen.

By doing this, you'll still receive push notifications and you'll hear the tones, your screen just will not light up and they won't filter into your actual Lock Screen area. Upon unlocking your iPhone or iPad, checking Notification Center will still show them, they just won't appear in the Lock Screen portion. Basically, your screen doesn't light up every time you receive a notification from these apps any longer when the View on Lock Screen option is turned off. Less screen use equals better battery life. By doing this myself, I gained about an extra 15 to 25% battery life per day.

I've found this to be useful on apps I still want to know I'm receiving notifications for but don't necessarily need them on my Lock Screen such as Twitter and Facebook. I've also only get email notifications set up for VIP when it comes to the Lock Screen.

CALGARY, Alberta (AP) ? About 65,000 residents of Calgary were being allowed to return to their homes Sunday to assess the damage from flooding that has left Alberta's largest city awash in debris and dirty water.

Some were returning to properties spared by flooding, but others were facing extensive repairs to homes and businesses.

About 75,000 people had to leave at the height of the crisis as the Elbow and Bow rivers surged over their banks Thursday night. Three bodies have been recovered since the flooding began in southern Alberta and a fourth person was still missing.

"We've turned a corner, but we are still in a state of emergency," Calgary Mayor Naheed Nenshi said. "Our hearts and thought and prayers are with our colleagues downstream."

People in the eastern part of the province headed for higher ground as the flood threat remained. In Medicine Hat, Alberta, thousands of people have left their homes as water levels rose on the South Saskatchewan River. The river was not expected to crest until Monday, but by Sunday morning it was lapping over its banks in low-lying areas and people were busy laying down thousands of sandbags.

In Calgary, Nenshi said crews were working hard to restore services and he thanked residents for heeding the call to conserve drinking water.

He had already warned that recovery will be a matter of "weeks and months" and the damage costs will be "lots and lots."

While pockets of the city's core were drying out, other areas were still submerged. The mayor didn't anticipate that anyone could return to work downtown until at least the middle of the week. The downtown area was evacuated Friday.

The city's public schools were also to remain closed Monday.

Nathan MacBey and his wife found muddy water had risen to about kitchen counter level in their Calgary home at the peak of the flooding. His basement is still swamped and the main floor of the home is covered in wet mud.

"This is unprecedented," said the father of two, his voice cracking with emotion. "Not being able to give our kids a home, that's tough. ... We can survive, it's just the instability for the kids."

Alberta Municipal Affairs Minister Doug Griffiths said that 27 communities in Alberta were under states of emergency ? with some areas slowly starting to emerge from the watery onslaught and others still bracing for it

Griffiths said no place has been hit harder than the town of High River south of Calgary and it will be some time before residents there will be allowed back.

The waiting and worrying were causing tensions and emotions to run high, but Griffiths said virtually every home in the town of 18,000 would need to be inspected.

In High River, about 350 members of the Princess Patricia's Canadian Light Infantry from Edmonton have been assisting police in reaching homes that still haven't been checked. Armored vehicles have been churning through submerged streets and Zodiac watercraft have been used to reach the hardest-hit areas.

Back in Calgary, the water has taken a toll outside residential neighborhoods as well. The Saddledome hockey arena, home of the National Hockey League's Calgary Flames, was extensively damaged. The team said boards, dressing rooms, player equipment and several rows of seats were a total loss.

The rodeo and fair grounds of the world-famous Calgary Stampede were also swamped, although Nenshi was optimistic that things would be cleared up in time for the show to open July 5.

Nenshi said Sunday that all the major hotels in the downtown were closed and advised visitors to plan accordingly.

The federal Conservative party had planned to hold a policy convention in Calgary next weekend, but that's been postponed and a new date hasn't yet been set.

The mountain town of Canmore was one of the first communities hit when the flooding began on Thursday. Residents there have been allowed to return to 260 evacuated homes, but the Royal Canadian Mounted Police says 40 more are too damaged to allow people back.

In Saskatchewan, efforts are underway to move more than 2,000 people from their homes in a flood-prone part of the province's northeast.
